Meranti DMCA Policy

Light Year Software, LLC, an Ohio limited liability company doing business as Meranti (“Meranti,” “we,” “us,” or “our”), respects the intellectual property rights of others and expects our Customers to do the same. This policy explains how to notify us of claimed copyright infringement on a Customer Site we host, and how we respond, under the Digital Millennium Copyright Act ("DMCA"), 17 U.S.C. § 512. Capitalized terms used in this DMCA Policy but not otherwise defined herein have the meanings set forth in the Terms, including “Services,” “Customer Site,” “Customer Content,” “Visitor Content,” and “Your Content,” have the meanings given in Section 1 of the Terms of Service.
1. What this policy covers
Meranti provides hosting and website services for Customer Sites. Customers, not Meranti, determine the content displayed on their Customer Sites, and Meranti does not create, select, or control Customer Content. This DMCA Policy applies to content stored on or transmitted through our systems at a Customer’s direction, including Visitor Content appearing on a Customer Site.
If the material you are concerned about is a Visitor Content item, such as a blog comment, you may get a faster result by contacting the site owner first. Customers whose sites accept Visitor Content may wish to register their own DMCA agent with the U.S. Copyright Office.

3. How to submit a notice
Your notice must be in writing and include all of the following:
3.1. A physical or electronic signature of the copyright owner or a person authorized to act on the owner’s behalf.
3.2. Identification of the copyrighted work you claim is infringed, or, if one notice covers multiple works on a single site, a representative list of those works.
3.3. Identification of the material you claim is infringing and information reasonably sufficient for us to locate it, such as the specific URL of each page or file.
3.4. Your name, mailing address, telephone number, and email address.
3.5. A statement that you have a good faith belief that the use of the material in the way complained of is not authorized by the copyright owner, its agent, or the law.
3.6. A statement that the information in the notice is accurate, and, under penalty of perjury, that you are the copyright owner or authorized to act on the copyright owner’s behalf.
A notice that does not substantially meet these requirements may not be acted on. Before sending a notice, please consider whether the use may be a fair use.
4. What happens after we receive a valid notice
When we receive a notice that substantially meets Section 3, we may remove or disable access to the identified material in order to comply with applicable law and maintain the protections available under 17 U.S.C. § 512. If we cannot remove only the specific item, we may temporarily disable the page or Customer Site where it appears. We will take reasonable steps to promptly notify the affected Customer and send them a copy of the notice. That copy may include the contact information you provided.
5. Counter-notification
If you are a Customer and believe material was removed by mistake or misidentification, you may send a counter-notification to our Designated Agent. It must include:
5.1. Your physical or electronic signature.
5.2. Identification of the material that was removed or disabled and the location where it appeared before it was removed.
5.3. A statement, under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
5.4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district where your address is located (or, if your address is outside the United States, any judicial district in which Meranti may be found), and that you will accept service of process from the person who sent the original notice or that person’s agent.
When we receive a valid counter-notification, we will notify the complaining party that we intend to restore the material and, absent notice of a filed court action, will restore the material no less than ten (10) and no more than fourteen (14) business days after receipt of the counter-notification, unless our Designated Agent first receives notice that the complaining party has filed a court action seeking to restrain the Customer from the claimed infringement.
6. Repeat infringers
We will terminate, in appropriate circumstances, the accounts of Customers who are repeat infringers. As a general guideline, an account that receives three valid infringement notices within a 12-month period that are not successfully challenged, withdrawn, or otherwise resolved may be subject to termination. We may terminate accounts sooner in cases involving willful, repeated, or egregious infringement.
7. Misrepresentations
Under 17 U.S.C. § 512(f), anyone who knowingly and materially misrepresents that material is infringing, or that material was removed by mistake or misidentification, may be liable for damages, including costs and attorneys’ fees.
8. No duty to monitor
We do not proactively monitor Customer Sites for potentially infringing material and have no obligation to do so. Our failure to identify or act on particular content does not constitute approval of that content or a waiver of any rights under this policy or applicable law.
9. Other complaints
We may investigate trademark complaints and take action where appropriate, but the notice-and-counter-notice procedures in this policy apply only to copyright claims.
